Consent to Establish is to be obtained prior to establishing any industry or process.

Once the industry or process plant is established along the required pollution control systems, the entrepreneur is required to obtain Consent to Operate the unit. This consent is given for a particular period, which needs to be renewed regularly.

Application Process

CONSENT TO ESTABLISH (CTE)

  • The project proponent shall apply for consent only through Online Consent Management & Monitoring System (OCMMS) or through relevant Online portals.
  • The Online portals allows the industries for online submission of application for Consent to Establish, Consent to Operate, Renewal of Consents, uploading of documents, online payment of consent fee, online submission of clarification and for knowing the status of application.
  • After submission of application in complete shape, it will be processed and site will be inspected by the officers of Pollution Board/Committee. Thereafter, the subject will be placed before the respective Committee and decision will be taken.
  • The applications which are in complete shape will be cleared and consent for establishment will be issued for a validity period of one to seven years.
  • If the project proponent is not able to complete the establishment of the project within stipulated years, then he/she has to apply for extension of CTE one month before the expiry of CTE. Extension of CTE will be issued after field inspection by the concerned Officer.

CONSENT TO OPERATE (CTO)

  • The Industries have to apply for the Consent to Operate for the industry 30 days in advance of the commissioning of the operation.
  • The application shall be submitted through OCMMS or Other relevant Online portals. The Concerned Officer will inspect the industry to verify whether all the conditions imposed in the consent for establishment have been complied with.
  • The above report will be scrutinized and consent for operation will be granted for a period of 5 to 15 years.

CTO validity period is as follows:

  1. Green Category Industry- 15 Years
  2. Orange Category Industry- 10 Years
  3. Red Category Industry- 5 Years

Layout Plan of the Industry

Project report (including manufacturing process, with process flow diagram and sources of emission, effluent and hazards / solid waste and pollution control measures)

Capital Investment Certificate

Emission and Effluent Test Reports (for CTO)

Additionally, specific State Pollution Control Board or Committee may require other documents such as Electricity and Water Bill, CETP registration, Geo tagged pictures of industry, Water balance chart, Details of ETP/STP/pollution control equipment etc.

Categorisation of Industries (R/O/G/W)

Categorization of Industrial Sectors under Red, Orange, Green and White Category.

Central Pollution Control Board (CPCB) has developed the criteria of categorization of industrial sectors based on the Pollution Index which is a function of the emissions (air pollutants), effluents (water pollutants), hazardous wastes generated and consumption of resources. For this purpose, the references are taken from the the Water (Prevention and Control of Pollution) Cess (Amendment) Act, 2003, Standards so far prescribed for various pollutants under Environment (Protection) Act, 1986 and Doon Valley Notification, 1989 issued by MoEFCC.

The Pollution Index PI of any industrial sector is a number from 0 to 100 and the increasing value of PI denotes the increasing degree of pollution load from the industrial sector. Based on the series of brain storming sessions among CPCB, SPCBs and MoEF&CC, the following criteria on ‘Range of Pollution Index ‘for the purpose of categorization of industrial sectors is finalized.

Industrial Sectors having Pollution Index score of 60 and above – Red category

Industrial Sectors having Pollution Index score of 30 to 59 –Orange category

Industrial Sectors having Pollution Index score of 21 to 29 –Green category

Industrial Sectors having Pollution Index score upto 20 -White category

The categorization is made on the basis of following:

  1. Quality of emissions (air pollutants) generated
  2. Quality of effluents ( water pollutants) generated
  3. Types of hazardous wastes generated
  4. Consumption of resources
